On May 3, the Ministry of Culture, Sports and Tourism (MCST) began a legislative preview of the proposed enforcement decree of the ‘Art Promotion Act,’ which is scheduled to take effect on July 26. The legislative preview will run until June 13 to collect public opinions on the proposed law.

The core contents of the ‘Art Promotion Act,’ which was enacted on July 25 last year, include ▴ establishing an institutional foundation for promoting systematic art promotion policies and introducing a public art bank, ▴ establishing an institutional cornerstone to support the art industry in a structured manner, and ▴ introducing a resale compensation claim right to guarantee the rights of artists.

The proposed enforcement bill for the ‘Art Promotion Act’ includes provisions for the establishment of an institutional foundation and the introduction of a public art bank. The art service industry notification system (enforced on July 26, 2026) and the right to resale compensation (enforced on July 26, 2027), which are intended to be incorporated into the art industry’s institutional system, are planned to be subordinate laws through on-site communication processes in time for their respective implementation.

Institutions, organizations, or individuals with opinions can submit their comments online through the Public Participation Legislation Center (http://opinion.lawmaking.go.kr), or submit a comment letter to the MCST, stating the submitter’s name (organization name and representative name for organizations), address, phone number, and itemized comments on the notice.

In addition, the Ministry of Culture, Sports, and Tourism will hold expert meetings and public hearings along with the legislative preview of the Enforcement Decree of the ‘Art Promotion Act’ to hear vivid opinions from the field. In May, the ministry will hear from experts in various fields related to art, including creation, criticism, exhibition, distribution, administration, management, international exchange, and law.

On Thursday, May 23, at 10 am., a public hearing will be held at the Multipurpose Hall of Hyehwa Artist House. The hearing will explain the main contents of the proposed enforcement decree of the Art Promotion Act, followed by a discussion by experts and questions and answers from attendees. All interested parties are welcome to attend without prior application.
